1. Description of Service
The Platform provides a peer-to-peer texting service that allows users to send and receive text messages in a controlled environment. The Platform is intended to facilitate communication between individuals and organizations, subject to compliance with applicable laws and regulations.
2. User Conduct
You agree to use the Platform only for lawful purposes and in compliance with all applicable laws and regulations. You shall not:
a. Use the Platform for any unauthorized or illegal purpose.
b. Engage in any activity that interferes with or disrupts the integrity or performance of the Platform.
c. Send unsolicited or unauthorized advertising, promotional materials, or spam messages.
d. Impersonate any person or entity or falsely state or otherwise misrepresent your affiliation with any person or entity.
e. Collect, use, or disclose personal information of others without their consent.
f. Violate the privacy rights, intellectual property rights, or any other rights of any person or entity.
g. Use the Platform to harass, abuse, or harm others, or engage in any form of hate speech or discriminatory behavior.
3. Intellectual Property
All content and materials available on the Platform, including but not limited to text, graphics, logos, button icons, images, audio clips, data compilations, and software, are the property of the Company or its licensors and are protected by intellectual property laws.
You are granted a limited, non-exclusive, non-transferable, revocable license to access and use the Platform and its content for personal or internal business purposes. You shall not modify, reproduce, distribute, create derivative works, publicly display, or perform any copyrighted material without the prior written consent of the Company.
4. Privacy
The Company respects your privacy and is committed to protecting your personal information. Please refer to the Company's Privacy Policy for information on how your personal data is collected, used, and disclosed when you use the Platform.
5. Limitation of Liability
To the fullest extent permitted by applicable law, the Company shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to damages for loss of profits, data, or other intangible losses, arising out of or relating to your use of or inability to use the Platform, even if the Company has been advised of the possibility of such damages.
6. Indemnification
You agree to indemnify and hold the Company, its affiliates, officers, directors, employees, and agents harmless from and against any claims, liabilities, damages, losses, and expenses, including reasonable attorneys' fees, arising out of or in any way connected with your use of the Platform or violation of this Agreement.
7. Modifications to the Platform and Agreement
The Company reserves the right to modify, suspend, or discontinue the Platform, or any part thereof, at any time and without prior notice. The Company may also modify this Agreement from time to time, and the updated version will be effective upon posting on the Platform.
8. Governing Law and Jurisdiction
This Agreement shall be governed by and construed in accordance with the laws of the United States. Any legal action or proceeding arising out of or relating to this Agreement shall be exclusively brought in the courts located in the United States, and you hereby consent to the personal jurisdiction of such courts.
